Terms & Conditions

Quotations 

Our quotations are valid for 30 days from date of submission. MindMarket reserves the right to revise quotations after this date.

MindMarket will endeavour to assess the feasibility of each project prior to quotation, however, in some cases, this may not be possible until fieldwork has commenced. 

In the absence of an agreement to the contrary, initial research findings and proposals provided by MindMarket, when MindMarket receives neither the commission nor payment for the proposals, remain the property of MindMarket. Their contents cannot be revealed to third parties without permission.

Invoices & Charges 

Invoices are payable in USD unless agreed otherwise in writing. 

Where incentives are included, MindMarket processes eGift card or PayPal payments for respondents as standard, this carries a provision of 15% handling.

***Please note that incentives of USD $1k+ will be invoiced in full at commission stage, payable upon receipt*** 

If you would like to pay respondents then we are happy for you to organise incentives.

Postponement, Cancellation & Charges 

In the event of a project being postponed or cancelled, cancellation fees will be charged at the following rates: ​​

  • 5 or more working days prior to fieldwork commencing (or first venue date):  Set-up and Project Management Fee plus Recruitment Fees for Respondents already notified to the Client plus any unrecoverable third-party costs, including but not limited to, cancellation fees charged by research facilities, moderators, and other suppliers

  • Between 24 hours and 5 working days: 100% of the total Fees set out in the Project Confirmation Form less the Incentive Fees

  • Less than 24 hours: 100% of the total Fees set out in the Project Confirmation Form

Changes to the questionnaire once programming and/or translations have begun may be subject to further charges. 

Late delivery of materials, or any action/decision by the client which delays / cancels fieldwork may be subject to further charges. 

All changes to field specifications must be made in writing.

Reasonable Control 

MindMarket shall not be held liable for delays or delivery failure that arise from an act or event beyond MindMarket’s reasonable control (including, but without limitation, strikes, postal/communication delays, industrial action, fire/accident, governmental act, natural catastrophe or any other act or event beyond the control of MindMarket). 

MindMarket shall not be held liable for any failure or defective working of audio or visual equipment at viewing facility or for any subsequent cost incurred.

Incidence 

Unless otherwise specified all costs are provided assuming 80% incidence. MindMarket reserves the right to adjust costs to consider a more accurate incidence rate based on screen out information provided.

Materials 

In line with GDPR, where possible and unless otherwise agreed, all completed project material will be sent back electronically or deleted after project completion. Courier costs are not included and will be charged at cost. 

Digital safety copies of completed materials will be kept for one month from final invoice date, unless otherwise agreed in writing.

Respondent Recruitment 

The MindMarket operates the following policy, unless otherwise agreed in writing by the client:

  1. If we have recruited an over-recruit and you no longer require them on the day: full incentive payable to respondent

  2. If the respondent is a no show/late: no incentive payable

  3. If you cancel giving less than 48 hours notice (considering local time zones for respondents): full incentive payable

Remote Interviews/Online Communities
  1. If we have recruited an over-recruit and you no longer require them on the day: full incentive payable to respondent

  2. If the respondent is a no show/late: no incentive payable

  3. If you cancel giving less than 24 hours notice (considering local time zones for respondents): full incentive payable

Recruitment Charges

We will agree with you at project commencement, however, please note our standard policy below:

  • If we have recruited an over-recruit and you no longer require them on the day: full recruit fee payable

  • If the respondent is a no show on the day of the research and has not informed MindMarket in advance: no charge

  • If the respondent is a no show on the day of the research and has informed MindMarket in advance and we find a valid replacement respondent: full recruit fee payable

  • If a respondent has set up a profile/tasks completed: full recruit fee payable

  • If you cancel a respondent giving less than 48 hours notice for F2F research: full recruit fee payable

  • If you cancel a respondent giving less than 24 hours notice for online research: full recruit fee payable


Recruit (only) where client, or clients’ agent conducts interviews (face to face or telephone/online) in office/home – costs assume that we will be given, in writing, interviewer availability and that interviewers will adhere to it. Any rearranging or cancellation of appointments will be charged in full. 

Personal data to third party – if this is required, please confirm before commencement of recruitment, what personal data you will require and what the personal data will be used for. 

If exclusions are not provided to MindMarket, in writing, before a project commences, any recruitment (and interview) that should have been excluded will be charged in full. 

List projects – costs and timings assume that the lists provided are up to date and accurate, with full titles, mobile & email address and have enough names to complete quota.  

Where the client is responsible for programming and hosting an online survey, it is assumed that there will be an autostop in place to prevent the commissioned quota being exceeded. If this is not the case, all additional completes will be charged on a pro-rata basis.

Re-contact 

In accordance with the MRS Codes of Conduct, respondents must be informed at recruitment of any future re-contact. If there are to be future stages/waves (not currently commissioned) that require us to ask a re-contact question, you must inform us: when the re-contact will occur, the purpose of the re-contact, who will be conducting the re-contact (MindMarket, another party or both).

Code of Conduct & Data Protection 

MindMarket is registered with the Office of the Information Commissioner and to comply with the Data Protection Act, our client must confirm that any contact details they provide have been notified and given consent that their names and information may be used for market research. We will notify our client of instances where the individual is no longer at the address (but not of any new address), not known, deceased or declined to be interviewed.

Privacy Policy

MindMarket adheres to the Market Research Society, in particular the articles governing client and respondent confidentiality, data protection, and the use of research findings. In accepting a quotation from MindMarket a client is deemed to agree to be bound by this professional code.

This Agreement shall be governed and construed in accordance with English laws and each party agrees to submit to the non-exclusive jurisdiction of the courts of England as regards any claim or matter arising under this Agreement.
